Measures involving the legalization of marijuana were on the ballot in four states in Tuesday’s election.
One of the most closely watched campaigns was in Florida, where the Associated Press reports that an amendment to legalize recreational marijuana went down to defeat. It fell short of the 60% total required to approve constitutional amendments. The measure would have allowed recreational sales of marijuana to people over 21 from existing medical marijuana dispensaries. It would have also allowed medical marijuana treatment centers and other licensed state entities to acquire, cultivate, process, manufacture, sell and distribute marijuana products and accessories.
In Nebraska, voters approved two legalization measures. One would allow marijuana for medical use and the other to regulate the medical marijuana industry in the state.
70.7% of voters passed a statute that would legalize the use, possession, and acquisition of up to 5 ounces of cannabis for medical purposes. 66.9% approved a statute that would legalize the possession, manufacture, distribution, delivery, and dispensing of cannabis for medical purposes by registered private entities. The statute would also establish the Nebraska Medical Cannabis Commission to regulate the industry.
In North Dakota, voters rejected Measure 5, which would have allowed the consumption and sale of recreational marijuana for adults over 21 and created a regulatory body for the drug.
South Dakota was considering a measure to legalize recreational marijuana and allow the possession, growing, ingesting and distribution of marijuana and marijuana paraphernalia by adults 21 and older. That measure was trailing on Wednesday morning.
It was the third time legalization of marijuana had been on the ballot in North Dakota and South Dakota.
Entering the election, 24 states and the District of Columbia had legalized marijuana for adults. A total of 38 states and the District of Columbia had laws allowing the medical use of marijuana. Possessing or selling marijuana remains a crime under federal law
